In Tasmania, according to the 1995 Workplace Health and Safety Act, it becomes the duty of the employer to analyze the possible health and safety threats at the work place and do away with them to protect the people who work there and even those who just enter and exit. In addition to the above it becomes specific for the person who controls the workplace as per the 1998 Workplace Regulations of Health and Safety that the person in charge assesses the work environment for all possible risk and takes practical steps against the area that have Asbestos Containing Material (ACM). He will either replace the asbestos material with standardized safe material or will seal the ACM so that it does not contaminate the environment in any way. The workplace controller is also bound to conduct a risk assessment on the same.

 

The workplace controller should be a responsible person, who will ensure that the corporate body maintains a register, which is implemented after being developed and maintained, that shows that all the ACM that has been identified at the workplace is regularly inspected and monitored for deterioration. It is then required for the Asbestos register to get involved with the Asbestos Management Plan, these documents are to be made and suitably assessed by a recognized occupational hygienist, who is qualified in this area of work. According to Tasmania legislative law, the asbestos register needs to be always up to date and be ready for any employee who may request for it as per the 1998 Workplace Regulations of Health and Safety. Furthermore, it becomes the legal duty of the workspace controller to inform all the employees of the presence and locations of ACM in their premises. The employer is also legally bound to fix signs to alert the people about the ACM location.

For a person in Tasmania who fails to comply with the critical aspects of the 1995 Workplace Health and Safety Act or even the 1998 Workplace Regulation for Health and Safety, he is punishable with a maximum 500 penalty units for a naturalized person and 1500 penalty units for a corporate body.
