According to the 1995 Workplace Health and safety Act, along with the 2008 Workplace Health and Safety Regulations that came in force from 1st January 2008, it has been made mandatory that all premises built before 1990 need to complete their asbestos workplace audit. They also need to put up the results on the work-site along with the year and month in which the audit was done.
According to Division 3 of Part 11of the 2008 Workplace Health and Safety Regulations, owners of structures and buildings, which are workplaces, will have to come into compliance till 1st January 2008. The Code of National Practice for Control and Management of Asbestos at the Workplace [2018 (2005): NOHSC] along with the Code for National Safe Removal of Asbestos [(2005): 2002] has in it the legislative requirements to be followed by employers of workplaces that have asbestos presence.
Northern Territory, Australia successfully promotes the safety measures to deal with Asbestos - fibrous minerals hazardous to human wellbeing. It imposes certain obligations on people operating businesses involving asbestos exposure and risks. Northern Territory Government has forbidden asbestos fibers and manufacture, stockpile, supply, transportation, trade use or reuse of any new materials containing asbestos.
According to 2000 Occupational Health and Safety Act, every employer should provide their employee with safety where health is concerned, which also means that all work premises and systems should be free from all risks. Employers on their path should provide enough instructions, information and training to see that all their employees remain safe and healthy. For a corporation that fails to comply with the standards of the above Act, the penalty is 5000 units and for an individual who fails to comply for the first time, it is 500 penalty units.
The 2008 Work Safety Act, the Legislations Amendment of the 2009 Work Safety Act along with the 2004 Dangerous Substances Regulations defines laws workplace safety in Australia. A controller or an employer of a non residential environment should take reasonably practical steps to provide protection to the people who work there and also to the people who come and go. It states that a person who controls the working premises that was built before 31st December 2003 in Australian Capital Territory needs to have an Asbestos Management Plan. It should be set in place into the maintenance schedule to be implemented on the premises.
