Centralized Claims

The centralized approach of the claims helps in ensuring the consistency in managing the legal responsibility of the asbestos-related Commonwealth. Also, allowing the management of claims to be more effective as well as efficient, by offering a single point for most statutory and common law claimants. Claims are against- Asbestosis- an asbestos related situation encouraged in carcinoma- a Mesothelioma or an asbestos related non-malignant pleural disease or some further circumstance which is caused by a direct or indirect exposure to asbestos.

Purpose of Centralized Claims

In relation to the asbestos-related conditions, the agencies are advised to propose the new function of Comcare.

Asbestos claims against the Commonwealth

The Management of Commonwealth Liabilities (Asbestos-related Claims) Act of 2005 helps in transferring the Commonwealth’s common law personal injury asbestos liabilities with certain exceptions. These Commonwealth authorities give the Comcare, the exclusive authority for managing the claims in order to the transferred liabilities. A body corporate is recognized by a law of the Territory, Commonwealth or a company, for the purpose of Commonwealth authority. In it, the commonwealth has a controlling interest. The acts that benefit the workers compensation are- Military Compensation and Rehabilitation Act 2004, the Veterans Entitlements Act of 1986, Rehabilitation and Compensation Act of 1988.
